Terms & Conditions

Updated:

Please read sections 13 to 15 carefully. They explain limits on liability, the position of company representatives and a limited reimbursement obligation for certain business submissions. These provisions do not remove rights or remedies that South African law protects.

1. About these terms and who operates LoansPlus

LoansPlus.co.za (the “Website”) is operated by Profitech Credit Solutions (Pty) Ltd, a South African private company with registration number K2013214791 (the “Company”, “we”, “us” or “our”). References to LoansPlus mean the Website and the information, comparison and referral services provided by the Company.

Our published physical address is 1st Floor, 292 Surrey Avenue, Randburg, Johannesburg, 2194, South Africa. You can contact us at info@loansplus.co.za.

These terms govern use of the Website and our services. Where you expressly accept them, or otherwise enter into a binding agreement incorporating them, that agreement is with the Company. A business does not become a party to these terms merely because we publish information about it.

Our Privacy Policy and Cookie Policy explain how personal information and cookies are handled. Accepting these terms is not, by itself, consent to every form of processing or marketing. A separately agreed written advertising or referral contract takes precedence for the services it specifically covers, subject to applicable law.

You may save or print these terms for your records. We do not claim membership of a self-regulatory or accreditation body unless expressly identified on the Website.

2. Your statutory rights

Nothing in these terms excludes, restricts or modifies any right, remedy or obligation that cannot lawfully be excluded, restricted or modified. This includes applicable protections under the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, Protection of Personal Information Act 4 of 2013 and National Credit Act 34 of 2005.

These laws apply according to their respective scope and the circumstances of the service or transaction. Their inclusion here does not mean that LoansPlus is a credit provider or that every provision applies to every user.

This section takes precedence over every disclaimer, limitation of liability, indemnity and other provision below. These terms do not authorise misleading statements, unlawful publication or infringement of another person’s rights.

3. Our services, charges and eligibility

LoansPlus is an information, comparison and referral platform. We do not lend money, approve credit applications, set borrowing terms or enter into credit agreements on a credit provider’s behalf. Our content is general information, not personalised financial advice or an assessment of a product’s suitability for you.

Access to our comparison content and submission of a loan enquiry are free of charge. We do not collect a loan application or referral fee from consumers. Interest, fees, insurance premiums and other charges payable under any credit agreement are determined and disclosed by the relevant credit provider.

A listing, comparison, article or referral is not an offer of credit or an assurance of approval, savings or a particular outcome. The credit provider is responsible for its lending decisions, affordability and credit assessments, disclosures and credit agreement. You are under no obligation to accept an offer.

You must be at least 18 and have legal capacity to submit a loan enquiry. Information must be supplied for yourself or with appropriate authority. A provider may impose additional eligibility requirements.

Our listings do not represent a complete survey of the South African market. Inclusion does not, by itself, establish a provider’s regulatory status, financial standing or suitability. Where relevant, registration can be checked through the National Credit Regulator’s register.

4. Information, rates and calculators

We take reasonable care when preparing information, but provider details and product terms may change between updates. Advertised rates, amounts, fees, eligibility criteria and payout times may be conditional. A starting rate may not be available to every applicant, and a maximum loan amount is not an indication of what you will qualify for.

Confirm current information directly with the provider and read the pre-agreement statement and quotation and credit agreement before accepting an offer. Consider the total amount repayable, including applicable interest, initiation fees, service fees and credit life insurance, alongside the instalments, repayment term and any security requirements.

Calculator results and repayment examples are estimates based on stated inputs and assumptions. They may not include every charge or reflect the provider’s calculation method. They are not personalised quotations or credit decisions.

Please report material inaccuracies to info@loansplus.co.za. We will review credible reports and correct material errors we identify.

5. Business listings and editorial control

We may publish original descriptions, comparisons and factual information about providers using public sources, information supplied to us and other material we are lawfully entitled to use. A listing may be created without a commercial relationship with the business concerned, where publication is lawful.

Subject to applicable law and any binding agreement, we retain editorial control over the selection, wording, organisation, updating and retention of listings. A listed business does not acquire ownership of our original content or a right to approve it merely because the content refers to that business.

Our approach is to retain accurate, relevant and lawfully published factual listings. A preference not to be listed, disagreement with a substantiated comparison, withdrawal from an affiliate programme or the end of an advertising relationship does not, by itself, require deletion of an otherwise lawful listing.

Where appropriate, we may update a listing to reflect a closure, rebrand or discontinued product rather than delete it. Historical information will be identified as such and must not imply that an unavailable service remains available. Retention remains subject to privacy, accuracy, intellectual property and other legal requirements.

6. Corrections, objections and removal requests

Send listing concerns to info@loansplus.co.za, using “Listing correction” or “Listing removal request” in the subject line. Identify the page URL, the specific material concerned, your relationship to it, the reason for your request and any supporting evidence. We may request proportionate verification of identity or authority where necessary.

We assess requests on their merits, including concerns about accuracy, defamation, copyright, trade marks, confidentiality and personal information. Where a correction, clarification, removal of a particular image or deletion of specific personal information adequately resolves the concern, we may retain the remaining lawful listing.

We aim to acknowledge requests within five business days and provide an outcome within 20 business days. Complex matters may require more time, in which case we will explain the delay where reasonably practicable. We prioritise credible reports of serious harm or unlawful content and comply with applicable statutory deadlines.

We may restrict disputed material while reviewing it. A request does not automatically require removal, but neither publication nor these terms overrides a valid legal right or binding order.

The Protection of Personal Information Act (“POPIA”) can protect information about identifiable living individuals and, where applicable, existing legal entities such as companies. Public availability does not remove applicable privacy obligations. We assess objections, correction requests and requests for deletion or restricted retention accordingly.

We do not charge for considering a listing correction or removal request. We cannot directly remove material from websites or search services controlled by others.

7. Intellectual property and business identification

Copyright in our original text, design and other protected Website material belongs to the Company or its licensors. Business names, product names, trade marks and third-party materials remain subject to their owners’ rights. Public availability does not, by itself, make protected material free to reproduce.

References to businesses and products are used for identification, information and comparison where lawful. Logos, images and substantial extracts require permission or another applicable lawful basis. A reference or link does not itself imply endorsement, sponsorship or affiliation.

You may read, link to and make reasonable personal copies of our content. Substantial republication or commercial reuse of protected material requires permission unless permitted by law. Nothing here restricts lawful quotation, criticism, review or other statutory exceptions.

8. Material supplied for publication

If you submit descriptions, images, logos or other material specifically for publication, you confirm that you have authority to supply it and that, to your knowledge, it is accurate and lawful. You retain ownership and grant us a non-exclusive, royalty-free licence to reproduce, format, reasonably edit and display it for the submitted listing or publication. Editing must not materially misrepresent its meaning.

Unless separately agreed, you may withdraw this permission by written notice. We will stop using material that depends on that permission within a reasonable period, sooner where legally required. Withdrawal does not require deletion of independently sourced facts or our original content that we can otherwise lawfully retain. Copies needed for legal records remain subject to applicable retention requirements.

This publication licence does not apply to loan enquiries, identity documents, financial information or private correspondence submitted for another purpose.

9. Advertising, referrals and commercial relationships

We may receive advertising payments, referral fees or affiliate commissions from providers or commercial partners, including compensation when a referred loan is funded. These arrangements help support the Website.

Rankings and placements are not sold and do not depend on payment or commission. Any separately identified sponsored or promoted content will be labelled so its commercial nature is clear. A commercial relationship does not establish that a product offers the lowest cost or is suitable for you.

Payment does not entitle a business to misleading claims or the suppression of material corrections. Ending a paid arrangement ends the relevant paid services in accordance with its contract; it does not automatically remove a separate factual listing. We do not promise traffic, search rankings, enquiries or sales unless expressly agreed in writing.

Further information is available in our Affiliate Disclaimer. Applicable law takes precedence over any inconsistent statement in that disclosure.

10. Enquiries, personal information and third-party services

Information submitted through an enquiry form must be accurate to the best of your knowledge and supplied with authority. Check your details and the form notices before submitting. How information is collected, used and shared is explained in those notices and our Privacy Policy.

An enquiry may be passed to participating credit providers or referral partners for the purposes disclosed when it is submitted. They may contact you about that enquiry and apply their own terms and privacy notices. We remain responsible for our own conduct and legal obligations when handling or sharing information.

These terms do not provide blanket consent to unrelated marketing, unrestricted onward sharing or indefinite retention. Where consent is required, it must be obtained separately and specifically. Electronic direct marketing must comply with POPIA, including applicable consent or existing-customer requirements and a means to object or unsubscribe.

You may contact us to withdraw consent, object to direct marketing or request access, correction or deletion, subject to applicable legal requirements. Withdrawal does not invalidate earlier lawful processing or require deletion of records we are lawfully required or entitled to retain. Personal information will be retained only for permitted purposes and periods.

You may ask us to stop processing an outstanding referral request. If your information has already been passed to a provider, you may also need to contact that provider directly. Cancelling a referral request does not cancel a credit agreement you have separately entered into.

External websites and providers operate separately from LoansPlus. Their products, lending decisions and performance are their responsibility. Linking or referring to them does not make the Company a party to your agreement with them or remove our responsibility for our own conduct.

11. Acceptable use

You must not use the Website to submit fraudulent enquiries, impersonate another person, publish unlawful material, distribute malicious software, access restricted systems without authority or materially disrupt the service. Automated access must not bypass access controls, infringe rights or impose an unreasonable load.

We may proportionately restrict access where reasonably necessary to address misuse, security threats or legal obligations. Where practicable, we will give notice and an opportunity to resolve the issue. Making a genuine complaint or exercising a legal right is not misuse.

12. Website availability and ending use

We may maintain, update or discontinue Website features for operational, security, editorial or legal reasons. Continuous availability and error-free operation are not promised. We remain responsible for applicable duties concerning the quality and performance of our own services.

You may stop using our free services without a cancellation fee. Any separately contracted paid service remains subject to its agreement and applicable rights to notice, cancellation, cooling-off or a refund. These terms do not create a general right to cancel a lender’s credit agreement; the relevant agreement and applicable law determine those rights.

13. Responsibility and limitations of liability

This section limits certain claims against the Company, subject to section 2 and applicable law.

We are not responsible for losses to the extent they are caused solely by a provider’s independent conduct, information you supply incorrectly, your unlawful use of the Website or events outside our reasonable control. These provisions do not excuse loss caused or contributed to by our own breach of duty.

To the extent permitted by law, we exclude liability for losses too remote to be recoverable under applicable law. For business users bound by these terms, we also exclude indirect or consequential business losses, subject to applicable protections against unfair terms. Direct losses are not excluded merely by describing them as consequential.

No exclusion or limitation applies to fraud, wilful misconduct, gross negligence or liability that cannot lawfully be excluded or limited. This includes protected claims arising from the conduct of persons acting for or controlled by the Company. Nothing removes responsibility imposed by applicable consumer, credit, privacy, intellectual property or defamation law.

14. Alexander Balanoff and other company representatives

Alexander Balanoff and other authorised representatives act for the Company when carrying out Website activities within their authorised roles. Identification as an author, editor, contact person or other representative does not, by itself, make that person a party to an agreement with you, a credit provider or a personal guarantor of the Company’s obligations.

Unless expressly agreed in a separate personal undertaking, contractual obligations under these terms are those of the Company. Any claim against an individual must have a lawful basis independent of that person’s identification on the Website.

This section does not exclude personal liability imposed by law, including liability for a person’s own fraud, wilful misconduct, gross negligence or other conduct for which liability cannot lawfully be excluded.

15. Limited indemnity for business submissions

This section creates a limited obligation for certain business contributors to reimburse the Company. It does not apply to individuals using our comparison or referral services for personal purposes.

If you act in a business capacity and expressly accept these terms when supplying material for publication, you agree to reimburse the Company for reasonable, evidenced losses and legal costs arising from third-party claims directly caused by your knowingly false statements, deliberate infringement of another person’s rights or material breach of your authority to supply that material.

This obligation does not cover losses attributable to our own fault, unauthorised alterations or amounts already recovered from another source. We will notify you promptly, take reasonable steps to reduce loss and allow you to participate in the defence. We will not agree a settlement payable by you without your consent, which must not be unreasonably withheld.

Section 2 applies. This indemnity does not override protections available under the Consumer Protection Act or other applicable law, including protections that may apply to a business user.

16. Changes to these terms

We may update these terms to reflect changes in the Website, our services or the law. We will publish the revised version and its effective date. For material changes affecting an ongoing agreement, we will provide reasonable advance notice and obtain further agreement where required.

Changes operate prospectively and do not remove accrued rights or retrospectively change how an existing dispute is handled. Changes urgently required for legal or security reasons may take effect sooner, with notice as reasonably practicable. Silence or failure to read an update does not supply consent where the law requires it.

17. Complaints, governing law and general provisions

South African law governs these terms. South African courts and tribunals with jurisdiction may hear disputes, subject to applicable procedures. This does not restrict mandatory rights to use another competent forum, contact a regulator or seek urgent relief.

Direct Website complaints to info@loansplus.co.za, identifying the issue, relevant page or enquiry reference and the outcome sought. We will assess the complaint within a reasonable time and may request further information.

Complaints about a credit provider’s decision, conduct or agreement should be directed to that provider and, where appropriate, the National Credit Regulator or a competent ombud. Personal-information complaints may be raised with the Information Regulator. Consumer-protection complaints may be raised with the National Consumer Commission or another competent body.

Our complaints process does not suspend statutory deadlines or limit access to legal remedies. You do not waive a right to complain by submitting an enquiry or accepting these terms.

If a provision is unenforceable, it is severed to the extent necessary and the remaining provisions continue where they can operate lawfully. A delay in exercising a right does not, by itself, waive that right. Provisions intended to continue after use of the Website ends remain subject to their stated limits and applicable law.
